Terms of Service

The agreement between ChurchDiary and the churches that use it, written to be read rather than skimmed.
1.The agreement
These terms are the agreement between ChurchDiary and the church or organisation that uses it (“you”). By creating an account, or by using the service, you accept them on behalf of that church or organisation, and you confirm you have the authority to do so.
How we handle personal data is set out in our Privacy Policy, which forms part of these terms.
2.The service
ChurchDiary is church management software: members and families, workers, finance, reports, communication, content, a church website and a mobile app, on the plan you choose. We may improve, change or retire features over time; we will not take away something central to your plan without telling you first.
3.Accounts and logins
- You give each worker or member their own login, and decide what each one may see and do.
- Keep passwords to yourselves. You are responsible for what is done through your church’s logins, and should tell us at once if you think one has been misused.
- The details you give us when you sign up must be true and kept up to date.
4.Plans and payment
Basic is free for up to 100 users. Standard and Advanced are charged per user per year, at the prices on our Pricing page when you subscribe. A user is any record in your account — a church, a worker or a member.
- Prices exclude taxes, which are added where the law requires.
- We will give at least 30 days’ notice of a price change, and it applies from your next renewal.
- SMS messages are charged separately, as shown on the Pricing page.
- If a payment is overdue, we may limit the account to the Basic plan’s features until it is settled. We will tell you before we do.
5.Online giving
Gifts made online go through the payment gateway your church connects, under that gateway’s own terms, and are paid to the church’s account, not to ChurchDiary. ChurchDiary records each transaction for the church; refunds, receipts and any tax treatment of gifts are between the church, the giver and the gateway.
6.Your data
What your church puts into ChurchDiary remains yours. You give us permission to store and process it only to run the service for you, and we do not use it for anything else.
You are responsible for:
- having a lawful reason, and consent where the law asks for it, to record what you record about your people — a parent’s or guardian’s for a child;
- recording only what you need, especially records of faith and identity documents;
- answering your people’s requests to see, correct or delete their records.
If you leave, ask us before closing the account and we will help you take a copy of your data. After the account closes, we delete it as the Privacy Policy describes.
7.Acceptable use
You agree not to:
- break the law, or help anyone else to, through the service;
- send messages people have not agreed to receive, or use the service to harass anyone;
- try to reach data that is not yours, probe or break the service’s security, or overload it;
- copy, resell or reverse-engineer the software, except where the law allows it.
A church website is the church’s own publication: you are responsible for what it says, and for having the right to publish the words, pictures and media on it.
8.Availability and support
We work to keep ChurchDiary available, Sunday morning included, and announce planned maintenance in advance where we can. We do not promise that it will never be interrupted. Support is by email at support@churchdiary.in.
9.Suspension and ending
You can stop using ChurchDiary at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Except in an emergency, we will tell you first and give you a chance to put things right.
10.Warranties and liability
The service is provided as it is, and as available. As far as the law allows, we are not liable for indirect or consequential loss, such as lost income or lost goodwill, and our total liability under these terms is limited to what you paid us in the twelve months before the claim.
Nothing in these terms limits liability that the law does not allow to be limited.
11.Changes, law and contact
When these terms change, the new version appears here with a new date. If the change is significant, we will tell account holders by email at least 30 days before it takes effect; using the service after that means you accept it.
These terms are governed by the laws of India, and the courts of Chennai have jurisdiction over any dispute.
